AGREEMENT TO TERMS

By accessing or using the Cashew Agency website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

SERVICES

Cashew Agency provides marketing and creative services including but not limited to brand strategy, creative design, performance marketing, social media management, email marketing, and analytics. Specific services, deliverables, and terms will be outlined in individual client agreements.

CLIENT RESPONSIBILITIES

When engaging our services, you agree to:

• Provide accurate and complete information necessary for project completion
• Respond to requests for feedback and approvals in a timely manner
• Ensure you have rights to any materials you provide to us
• Make payments according to agreed-upon terms

INTELLECTUAL PROPERTY

Upon full payment, clients receive ownership of final deliverables as specified in their agreement. Cashew Agency retains the right to display work in portfolios and marketing materials unless otherwise agreed. We retain ownership of all preliminary concepts, working files, and proprietary methodologies.

PAYMENT TERMS

Payment terms will be specified in individual client agreements. Unless otherwise stated, invoices are due within 30 days of receipt. Late payments may incur additional fees and may result in suspension of services.

CONFIDENTIALITY

Both parties agree to keep confidential any proprietary information shared during the course of our engagement. This obligation survives termination of services.

LIMITATION OF LIABILITY

Cashew Agency's liability is limited to the amount paid for services. We are not liable for indirect, incidental, or consequential damages. We do not guarantee specific results from marketing activities, as outcomes depend on many factors beyond our control.

TERMINATION

Either party may terminate services with written notice as specified in individual agreements. Upon termination, clients are responsible for payment of all work completed. We will provide reasonable assistance in transitioning services.

WEBSITE USE

When using our website, you agree not to:

• Use the site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the site
• Copy, reproduce, or distribute content without permission
• Interfere with the proper functioning of the site

CHANGES TO TERMS

We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.

GOVERNING LAW

These terms are governed by the laws of the State of California. Any disputes will be resolved in the courts of San Francisco County, California.
